Terms and Conditions

Unless otherwise agreed in writing, the legal relationship between the parties is governed by these general terms and conditions, which form an essential part of our acceptance of any contract. These conditions shall therefore prevail over any conditions of the customer. All conditions of this agreement apply to both existing and new Dewofire clients.

All information provided by us, including quotations, is given for informational purposes only and shall not be binding upon us. Any communication or indication made by us shall not create any obligation on the part of the company. The agreed terms will only be final after written acceptance of the order or quotation. Even then, prices at the time of delivery may be revised if the cost of wages or raw materials has increased due to circumstances beyond our control.

Even if an express agreement exists, we are released from any obligation in the event of circumstances beyond our control, without any right to compensation for the co-contracting party.

Complaints will no longer be admissible after the 8th calendar day following delivery or receipt, or after knowledge of the subject of the complaint, provided that this was not or could not have been known at the time of delivery. All complaints must be sent by registered letter to our registered office, with a precise description of the subject, nature, and extent of the complaint, together with a list of the commercial documents related to it ; otherwise they will be inadmissible.

Our invoices are payable in cash and without discount in Kortrijk on the invoice date. The presentation of debt instruments, delivery notes or the acceptance of bills of exchange does not constitute novation of debt. Payment is only considered complete upon receipt of the due amounts in our account. If payment is not made within 30 days of the invoice date, interest of 10% on the outstanding balance will be charged by operation of law and without prior notice of default.

Delivery times are approximate, unless otherwise confirmed in writing and expressly in the order confirmation.

Cancellation of an order constitutes a breach of contract, leading to conventional damages of 35%, without prejudice to our right to prove higher damages.

This contract is entered into for a term of 3, 5, or 10 years, with the option to terminate it annually by giving two months' notice prior to the start of a new maintenance period, via registered letter. Except for VME, annually renewable contracts can be entered into with Dewofire.

If a customer is ceasing operations due to bankruptcy, they must notify us in a timely manner via info@dewofire.be.

The client will be contacted annually by Dewofire via phone or email to schedule an appointment for periodic maintenance. If a client fails to respond after 3 calls or emails to their provided contact details, the outstanding annual amount must be paid without the service being performed.

If the client is not present at a scheduled appointment, 50% of the service amount will be charged. This amount will not be deducted from the next maintenance service.

Any subsequent technical maintenance will only be approved by Dewofire once the previous maintenance invoice has been paid in full.

The maintenance contract includes an annual inspection of the registered devices or installations on a date determined by us. Replacements, refills, and renewals are charged to the customer following acceptance of a quotation and/or unless otherwise agreed.

All Dewofire services are performed in accordance with applicable standards. Extinguishers, hose reels, and emergency lighting receive a 100% test according to industry best practices and APRAGAZ requirements.

Fire detection installations are subject to a 20% test on the detectors connected to the fire alarm control panel, unless otherwise agreed, and this is always for proper functioning. The rule requiring the annual replacement of 20% of the detectors is only upon the client's own request, and Dewofire will not carry this out without a specific order.

To guarantee the proper functioning of the installation, Dewofire will replace the batteries of the detection control panels without prior request at a cost of € 49.00 excl. VAT per battery.

The maintenance contract was concluded at the agreed prices. These prices are subject to annual adjustment based on the index and/or increasing or decreasing quantities.

After each maintenance intervention, the client will receive a report and/or inventory list, detailing any observations. To ensure the good durability and quality of the materials and to comply with safety inspections, it is strongly recommended to follow the advice/quotation.

In the event of full or partial non-payment of the debt by the due date without serious reason, the outstanding balance will be increased by 10% after a formal notice of default has been issued without success.

It is expressly agreed between the parties that all goods and equipment shall remain our property until full payment has been received. Any advance payments made shall remain ours as compensation, without prejudice to Article 4, which shall continue to apply as a minimum.

Pending disputes of a similar nature never entitle the buyer to suspend payment.

Recycling fees :
- removal of discarded portable fire extinguishers: € 15.00 excl. VAT per item
- mobile carts: € 29.00 excl. VAT per item
- hose reels: € 29.00 excl. VAT per item
- hose reel cabinets: € 29.00 excl. VAT per item
- emergency lighting: € 5.00 excl. VAT per item

Travel expenses are charged at € 0.80 per kilometer, unless otherwise stated in the contract.

Additional works for fire protection and fire detection are charged at € 69/h.

Interventions outside annual maintenance (weekdays):
- fixed price € 269.00 excl. VAT, including travel expenses and the 1st hour of work.
- Starting from the 2nd hour : €79.00 excl. VAT per additional hour.

Interventions outside annual maintenance (weekend/holidays):
- fixed price € 349.00 excl. VAT, including travel expenses and the 1st hour of work.
- Starting from the 2nd hour : € 89.00 excl. VAT per additional hour.

Intervention call - Remote assistance via phone or FaceTime : €50.00 per quarter hour.

The user must grant all necessary access to Dewofire BV personnel, to perform the services provided for in this agreement during normal working days and hours. If access is not granted, a negligence fee of       €150.00 excl. VAT will be charged.

An intervention for a technical repair only concerns the defect reported by the customer. Dewofire only performs a full inspection of the installation during maintenance and therefore disclaims all responsibility for damages resulting from other unreported defects that may be present in the installation. Any requested repair is performed subject to this limitation.

Dewofire shall not be liable for the worsening or spread of any incident or fire.

Intervention requests must be submitted via info@dewofire.be or by telephone to the landline.

Throughout the duration of the installation work performed by Dewofire, the customer is required to take out or adjust its fire insurance policy to cover the portion of damages exceeding 2,500,000.00 EUR. Dewofire automatically assumes that the customer has taken this step with its fire insurer prior to the start of the work and for the entire duration of the work. Upon simple request from Dewofire, the client shall provide a certificate from their fire insurer as proof of this waiver of recourse.

In any event, no claim may be brought against Dewofire for damages exceeding €2,500,000.00.

Dewofire shall not be held liable if the installation does not operate optimally after acceptance of the works, as proper operation depends on external factors, including the customer’s activities and whether a prior risk assessment (RA) was carried out before the works.

In case of dispute, only the courts in Kortrijk have jurisdiction.

Every agreement is governed by these terms and conditions and by Belgian law.
